By using the Ortho Calculator app or website, you signify your assent to these Terms and Conditions. If you do not agree to all of these Terms and Conditions, do not use the Ortho Calculator app or website. Ortho Calculator Inc. (“Ortho Calculator”) may revise and update these Terms and Conditions at any time. Your continued usage of the Ortho Calculator website (“Website”) or app (“App”) will mean you accept those changes.

1. The App Does Not Provide Medical or Dental Advice

The contents of the Ortho Calculator App and Website, such as text, graphics, calculators, case studies, and other materials created by Ortho Calculator or obtained from Ortho Calculator’s licensors and other sources (collectively, “Content”), are intended solely for informational and educational purposes for licensed dental professionals.

The orthodontic calculators are designed to assist clinical decision-making by providing calculations based on reputable orthodontic literature and clinical experience. These tools are not intended to make final treatment decisions and should not be taken at face value. Instead, they are intended to complement, not replace, professional judgment and critical thinking. The calculators are generalized tools and are not customized for any specific patient case. The treating orthodontist or dentist is solely responsible for assessing and tailoring care to each patient’s unique needs.

If you think you may have a medical or dental emergency, call your provider or emergency services immediately. Ortho Calculator does not recommend or endorse any specific tests, products, procedures, or other information that may be mentioned within the App or Website. Reliance on any information provided by Ortho Calculator, Ortho Calculator employees, or others appearing within the App or Website is solely at your own risk.

2. Eligibility

The App and Website are intended for use only by licensed dental professionals, including orthodontists, dentists, and qualified dental personnel. The ortho calculators are not intended for use by the general public. If you are not a licensed dental professional, please refrain from using or relying on the calculators or content provided here. By using the Ortho Calculator, you acknowledge that the ultimate responsibility for patient care lies with the treating clinician.

3. Subscription and Billing (Apple App Store Only)

Subscription Plans: Ortho Calculator offers monthly and annual subscription plans through the Apple App Store, each with a 1-week free trial period. Subscriptions renew automatically unless canceled at least 24 hours before the end of the trial or current billing period.

Billing: Payments are processed through your Apple account at the time of confirmation and upon each renewal.

Cancellation: Subscriptions can be canceled through your Apple account settings. Access to the App remains active until the end of the current billing period if canceled.

Refunds: We do not provide refunds for unused portions of subscriptions except where required by law.

4. Privacy Policy and Data Collection

For details on the information collected through the Website and App, please refer to our privacy policy.

Website Data: When you visit our Website (orthocalculator.org), certain information, such as IP addresses and browsing behavior, is collected by our website hosting provider.

App Data: The Ortho Calculator App does not collect any personal information from its users.

Third-Party Services: The App and Website may link to third-party websites. Ortho Calculator Inc. is not responsible for the privacy practices or content of these external sites.

5. Intellectual Property

All Content within the App and Website, including but not limited to text, images, graphics, and calculators, is the exclusive property of Ortho Calculator Inc. and is protected by intellectual property laws.

Permitted Use: Ortho Calculator authorizes you to view or download a single copy of the Content solely for your personal, noncommercial use as a licensed professional.

Any unauthorized use of the Content may violate copyright, trademark, and other laws. Your permission to use the Content automatically terminates if you breach these Terms, and you must immediately destroy any copies you have made of the Content.

6. Liability of Ortho Calculator Inc. and Its Licensors

Use of the Ortho Calculator App, Website, and Content is at your own risk. By using this tool, you acknowledge that the ultimate responsibility for patient care lies with the treating clinician. Ortho Calculator Inc. will not be held liable for any risks, complications, or outcomes associated with acting on the information provided by this app or website.

Information transmitted through the App or Website may be beyond the control of Ortho Calculator and its suppliers. Accordingly, Ortho Calculator assumes no liability for or relating to the delay, failure, interruption, or corruption of any data transmitted in connection with use of the App or Website.

The App and Website are provided “as is.” To the fullest extent permitted by law, Ortho Calculator and its suppliers disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, non-infringement, and fitness for a particular purpose.

Ortho Calculator Inc., its suppliers, or any third parties mentioned within the App or Website are not liable for any damages, including but not limited to incidental, consequential, personal injury/wrongful death, lost profits, or damages resulting from loss of data or business interruption. Any claims arising in connection with your use of the App or Website must be brought within one (1) year of the event giving rise to such action.

Use the App or Website for any unlawful purpose or in violation of local, state, national, or international laws.

Copy, reproduce, distribute, or create derivative works from the App or Website Content without prior written consent from Ortho Calculator Inc.

Share your login credentials or allow others unauthorized access to the App.

You expressly agree that the courts in Ontario, Canada, will have exclusive jurisdiction over any legal action or proceeding arising from your use of the App or Website.
